  1. ABOUT HOMETECH WALES

HomeTech Wales provides home improvements, property maintenance, home adaptations, technology support and independent living solutions.
The business is also registered as a micro provider with Denbighshire County Council and may provide services to older people, vulnerable adults and individuals requiring additional support.
These Terms and Conditions apply to all work undertaken by HomeTech Wales unless otherwise agreed in writing.

  1. ESTIMATES, QUOTATIONS AND FIXED PRICE QUOTATIONS

HomeTech Wales may provide estimates, quotations or fixed price quotations depending on the nature of the work.
An Estimate is an indication of likely costs based upon the information available at the time and is provided for budgeting purposes only. Actual costs may vary depending on labour, materials, site conditions or other factors identified during the course of the work.
A Quotation is a price for a defined scope of work based on the information available at the time of inspection. Quotations are prepared in good faith and are expected to remain valid for the stated scope of work. However, additional charges may arise where variations, hidden defects, unforeseen circumstances, customer requested changes or conditions not reasonably identifiable at the time of quotation are encountered.
A Fixed Price Quotation is a price for a clearly defined scope of work and will not normally change unless:
• The customer requests changes to the scope of work.
• Additional work is requested.
• Hidden defects or unforeseen conditions are discovered.
• Information provided by the customer is inaccurate or incomplete.
• Delays or additional costs arise from circumstances outside the reasonable control of HomeTech Wales.
Verbal indications of likely costs should be treated as budget estimates only and do not constitute quotations.
Written quotations are normally valid for 30 days unless otherwise stated.
Acceptance of an estimate, quotation, fixed price quotation, booking confirmation or instruction to proceed constitutes acceptance of these Terms and Conditions.

  1. SCOPE OF WORK

Quotations are based on the information available at the time of inspection or discussion.
The quotation will describe the agreed scope of work. Any work outside that scope may be subject to additional charges.
HomeTech Wales reserves the right to refuse instructions that would result in unsafe work, poor workmanship, non compliant installations or outcomes unlikely to provide a satisfactory long term result.

  1. CUSTOMER RESPONSIBILITIES

Customers are responsible for:
• Providing accurate information relating to the work required.
• Ensuring reasonable access to the property.
• Obtaining any permissions, approvals or consents required from landlords, management companies, neighbours or other third parties.
• Removing or protecting valuable, fragile or sentimental items from the work area.
• Informing HomeTech Wales of any known hazards, access restrictions or special requirements.
• Informing HomeTech Wales of any parking restrictions, shared access arrangements, permit requirements or other site conditions likely to affect the efficient delivery of the work.

  1. ACCESS, PARKING AND SITE CONDITIONS

Where access restrictions, parking arrangements, carrying distances, shared access disputes, permit requirements or site conditions result in additional labour, handling time, transport requirements, delays or costs, HomeTech Wales may make reasonable additional charges.
Where such issues are identified before work commences, HomeTech Wales will discuss available options and any likely additional costs with the customer.

  1. MATERIALS AND EQUIPMENT

HomeTech Wales may supply materials directly or install materials supplied by the customer.
Where HomeTech Wales supplies materials, reasonable efforts will be made to source suitable products that meet the agreed requirements.
Availability may occasionally be affected by supplier shortages, manufacturer changes or circumstances outside the control of HomeTech Wales.
Equivalent alternatives may be proposed where appropriate.

  1. SPECIALIST TRADES AND SUBCONTRACTORS

HomeTech Wales may recommend, engage or coordinate appropriately qualified specialist contractors where work falls outside the scope of services normally provided.
Where HomeTech Wales engages subcontractors directly, customers will be informed in advance.
HomeTech Wales will take reasonable care when selecting specialist contractors but remains responsible only for work undertaken directly by HomeTech Wales unless otherwise agreed in writing.
Where customers choose to engage third party contractors independently, HomeTech Wales accepts no responsibility for their workmanship, conduct, timescales, pricing or performance.

  1. CUSTOMER SUPPLIED MATERIALS AND EQUIPMENT

Customers may choose to supply materials, fixtures, fittings, equipment, hardware, software or other items for use as part of the work.
HomeTech Wales reserves the right to inspect customer supplied items before work commences and may decline to use any item considered unsuitable, unsafe, defective, incompatible, of inadequate quality or otherwise inappropriate for the intended purpose.
Where customer supplied materials are found to be unsuitable, HomeTech Wales may:
• Recommend alternative materials or products.
• Postpone work until suitable materials are available.
• Supply suitable alternatives at the customer’s expense.
• Decline to undertake part or all of the work.
Where customer supplied materials result in additional labour, delays, modifications, troubleshooting, remedial work or reduced installation efficiency, HomeTech Wales may charge for the additional time and costs incurred.
HomeTech Wales accepts no responsibility for defects, failures, incompatibility, delays, reduced performance, warranty issues or additional costs arising from customer supplied materials, equipment, fixtures, fittings, hardware or software.
HomeTech Wales cannot guarantee compatibility between customer supplied equipment and existing systems unless compatibility has been specifically assessed and confirmed.

  1. EXISTING CONDITIONS AND HIDDEN DEFECTS

Quotations are based on conditions that are visible and reasonably apparent at the time of inspection.
HomeTech Wales cannot be held responsible for hidden defects, concealed services, structural issues, previous poor workmanship, rot, damp, infestations, unsafe installations or other conditions that could not reasonably have been identified before work commenced.
Where such issues are discovered, work may be paused while options and any additional costs are discussed with the customer.
No additional work will be undertaken without customer agreement unless immediate action is required to make the area safe.

  1. VARIATIONS AND ADDITIONAL WORK

Customers occasionally identify additional jobs, changes or improvements once work has commenced.
HomeTech Wales will, where practical, try to accommodate reasonable additional requests.
Additional requests may:
• Be completed during the current visit.
• Require additional labour or materials.
• Be added to the final invoice.
• Require a revised quotation.
• Require a separate visit to be scheduled.
Unless expressly agreed otherwise, customers should not assume that additional work forms part of the original quotation, estimate or fixed price agreement.
Verbal instructions given during the course of work may be treated as authorisation for additional work and associated charges where it is reasonable to do so.

  1. TIME BASED WORK AND DAY RATES

Where work is agreed on an hourly rate, daily rate or time and materials basis, charges are based on the actual time reasonably required to complete the work.
Any indication of likely timescales should be regarded as guidance only unless expressly agreed as part of a fixed price quotation.
Customers acknowledge that the time required to complete work may be affected by factors including weather conditions, hidden defects, previous workmanship, customer requested changes, material quality, availability of materials, access restrictions, technical issues and health and safety considerations.
Where practical, HomeTech Wales will make reasonable efforts to minimise delays by undertaking alternative tasks, reordering work activities or attending other scheduled work where circumstances prevent progress on the original task.
Where significant or non trivial delays, variations or unforeseen circumstances arise, HomeTech Wales will keep the customer informed and discuss any likely impact on timescales, costs or project delivery at appropriate intervals.
Completion of a task in a longer period than anticipated shall not, by itself, constitute grounds for a reduction in agreed hourly or daily rate charges.
Reasonable time spent diagnosing faults, planning solutions, obtaining materials, collecting materials and undertaking related project activities may be chargeable where these form part of the agreed service.

  1. DEPOSITS AND PAYMENTS

HomeTech Wales does not normally require deposits for smaller projects.
However, deposits, stage payments or payment for materials may be requested for larger projects, special order items or projects involving significant material costs.
Payment terms will be stated on quotations or invoices.
Unless otherwise agreed, payment is due upon completion of the work and receipt of the invoice.
Ownership of materials supplied by HomeTech Wales remains with HomeTech Wales until payment has been received in full.
Where customers anticipate delays in payment, this should be discussed and agreed before work commences, materials are ordered or costs are incurred.

  1. PRACTICAL COMPLETION AND SNAGGING

Where work is substantially complete and fit for its intended purpose, HomeTech Wales may issue a final invoice.
Customers may retain a reasonable sum against agreed outstanding snagging items where appropriate. Unless otherwise agreed, any retention shall not exceed 10% of the contract value or £500, whichever is lower.
Outstanding snagging items shall not unreasonably delay payment for completed work.
HomeTech Wales will make reasonable efforts to complete agreed snagging items within an appropriate timescale.

  1. OVERDUE PAYMENTS AND SUSPENSION OF WORK

HomeTech Wales reserves the right to suspend work, postpone future visits, withhold delivery of materials or decline to commence subsequent stages of a project where invoices remain unpaid beyond the agreed payment terms.
Any resulting delays to project completion shall not constitute a breach of contract by HomeTech Wales.
HomeTech Wales reserves the right to charge interest, administration fees and reasonable recovery costs on overdue accounts where permitted by law.

  1. WASTE AND DISPOSAL

Removal and disposal of waste materials is only included where specifically stated within the quotation.
Unless otherwise agreed, removed materials, fixtures, fittings and equipment remain the responsibility of the customer.
Where HomeTech Wales arranges waste removal, skips, recycling or disposal services, the associated costs may be charged separately unless already included within the quotation.

  1. TECHNOLOGY SERVICES AND DATA

Customers remain responsible for maintaining backups of their own data unless a separate backup service has been specifically agreed.
HomeTech Wales cannot guarantee protection against data loss arising from hardware failure, software faults, cyber attacks, internet outages, manufacturer defects or pre existing issues.
Customers are strongly encouraged to maintain current backups before any work is undertaken.

  1. ACCESS CREDENTIALS AND SECURITY INFORMATION

Technology support services may require access to usernames, passwords, administrative credentials, network settings, CCTV systems, cloud services and other security related information.
Such information will only be collected, accessed or retained where necessary to provide the agreed service.
Where credentials are retained as part of an ongoing support arrangement, they will be handled in accordance with the HomeTech Wales Data Protection and Information Handling Policy.
Key safe codes, alarm codes and similar security information will not normally be retained unless this forms part of an agreed ongoing support arrangement.

  1. CCTV, SMART HOME AND CONNECTED SYSTEMS

HomeTech Wales cannot guarantee the continued operation of third party services, cloud platforms, mobile applications, internet services or manufacturer systems used in conjunction with CCTV, networking or smart home equipment.
Future changes made by manufacturers may affect functionality, compatibility or available features.
HomeTech Wales accepts no liability for interruptions caused by internet service providers, software developers, manufacturers or third party service providers.
HomeTech Wales will use reasonable discretion when configuring equipment, layouts and settings. Where specific preferences, locations, configurations or operational requirements are important to the customer, these should be discussed and agreed before work is completed.

  1. ADVICE, RECOMMENDATIONS AND DESIGN ASSISTANCE

HomeTech Wales may provide advice, recommendations and solution based guidance relating to products, layouts, adaptations, technology systems, materials and installation options.
Such advice is provided in good faith based upon the information available at the time.
Unless specifically agreed as a separate service, HomeTech Wales does not provide professional architectural, engineering, surveying or design consultancy services.
Where customers request detailed planning, drawings, CAD work, visualisations, mock ups, specifications or similar design related work, these may form part of a separately identified chargeable service.
HomeTech Wales cannot guarantee that recommendations made today will continue to meet future requirements, technologies, regulations or customer preferences.

  1. VULNERABLE CUSTOMERS AND MICRO PROVIDER SERVICES

HomeTech Wales recognises that some customers may be older, vulnerable or require additional support.
Reasonable adjustments will be made wherever practical to support customers in understanding quotations, services, invoices and communications.
Where appropriate, customers may choose to involve an authorised representative, family member, advocate or referring professional.
HomeTech Wales will normally assume that customers have the capacity, authority and informed consent necessary to make decisions, provide instructions and enter into agreements relating to the work being undertaken unless informed otherwise.
Where another person is responsible for financial decisions, payment authorisation, property management, legal affairs or other aspects of the project, this should be disclosed before work commences.
Customers are responsible for informing HomeTech Wales of any person whose approval, authority or consent may be required before work is undertaken, materials are ordered or costs are incurred.
HomeTech Wales cannot accept responsibility for disputes arising between customers and third parties regarding authority, payment arrangements, property ownership or decision making where these matters were not disclosed in advance.

  1. PHOTOGRAPHS

HomeTech Wales may take photographs before, during and after works for record keeping, project documentation, insurance purposes and quality assurance.
Permission for marketing photographs may be given verbally or in writing and may be withdrawn at any time before publication.
No personal information will be disclosed alongside photographs without additional consent.

  1. GUARANTEES AND WARRANTIES

Any workmanship guarantee offered by HomeTech Wales will be confirmed in writing where applicable.
Manufacturer warranties remain the responsibility of the manufacturer.
HomeTech Wales cannot extend, alter or guarantee manufacturer warranties.
Normal wear and tear, misuse, accidental damage, customer modifications, weathering, natural material movement or third party alterations may invalidate any workmanship guarantee offered.
Natural variations in timber, stone, paving, concrete, composite materials and other building products, including colour variation, weathering, movement, shrinkage, expansion, efflorescence and other naturally occurring characteristics, shall not be regarded as defects unless otherwise stated.

  1. CONDUCT AND SAFETY

HomeTech Wales reserves the right to suspend or terminate work where customer behaviour is abusive, threatening, discriminatory, unsafe or otherwise unreasonable.
HomeTech Wales also reserves the right to postpone work where continuing would compromise safety, workmanship, manufacturer requirements or the long term durability of the finished installation.

  1. SAFEGUARDING AND LEGAL OBLIGATIONS

Where evidence of abuse, neglect, exploitation, fraud, criminal activity or serious risk of harm is identified, HomeTech Wales reserves the right to share information with appropriate authorities in accordance with legal and safeguarding obligations.

  1. DOCUMENTATION AND ADMINISTRATIVE REQUIREMENTS

Standard quotations, invoices and supporting documentation will be provided in the format normally used by HomeTech Wales.
Where customers, representatives, organisations, insurers, funding bodies or third parties require additional documentation, reports, detailed cost breakdowns, schedules, evidence, photographs, specifications, supporting statements or other administrative work beyond HomeTech Wales’ standard documentation, this should be requested before work commences wherever reasonably possible.
HomeTech Wales may make reasonable charges for substantial additional administrative work requested beyond the standard documentation normally provided.

  1. COMPLAINTS

HomeTech Wales aims to provide a high standard of workmanship and customer service.
Any concerns should be raised as soon as possible to allow an opportunity for resolution.
Complaints will be handled in accordance with the HomeTech Wales Complaints, Concerns and Customer Feedback Policy.

  1. DATA PROTECTION

Personal information will be processed in accordance with the HomeTech Wales Data Protection and Information Handling Policy.
Copies of relevant policies are available on request.

GOVERNING LAW

These Terms and Conditions shall be governed by the laws of England and Wales and any disputes shall be subject to the jurisdiction of the courts of England and Wales.
