1. Purpose
This document explains the cancellation rights that may apply when customers enter into contracts with HomeTech Wales.
Cancellation rights vary depending on how and where the contract is made, the type of work being undertaken and the applicable legislation.
Nothing in this policy affects your statutory rights.
2. Contracts Made in Your Home or at a Distance
Where a contract is entered into in your home, by telephone, email or other distance communication, you may have the right to cancel the contract within 14 calendar days without giving a reason.
Where applicable, HomeTech Wales will provide the information required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3. Requesting Work to Begin During the Cancellation Period
Many customers ask HomeTech Wales to begin work before the 14 day cancellation period has expired.
If you request this, you expressly agree that:
- Work may begin before the cancellation period ends.
- You will pay for any work completed before cancellation takes effect.
- If the service has been fully completed within the cancellation period, your statutory right to cancel may no longer apply.
Where appropriate, HomeTech Wales may ask you to confirm this request in writing.
4. Bespoke and Special Order Items
Cancellation rights may not apply, or may be limited, where work involves:
- Bespoke or made to measure items.
- Special order materials.
- Products manufactured specifically for your project.
- Materials that cannot reasonably be returned to the supplier.
Where costs have already been incurred, HomeTech Wales reserves the right to recover reasonable expenses in accordance with the contract and applicable legislation.
5. Cancellation by the Customer
If you wish to cancel work before it has commenced, please notify HomeTech Wales as soon as possible.
Where materials have already been ordered, appointments reserved or other costs incurred, reasonable charges may apply.
Where work has already begun at your request, payment will normally be due for work completed and costs reasonably incurred up to the date of cancellation.
6. Cancellation by HomeTech Wales
HomeTech Wales reserves the right to cancel or suspend work where:
- It is unsafe to proceed.
- Required access is unavailable.
- Necessary permissions have not been obtained.
- Customer behaviour is abusive, threatening, discriminatory or otherwise unreasonable.
- Payment obligations have not been met.
- Circumstances outside the reasonable control of HomeTech Wales prevent the work from being completed.
Where appropriate, any monies due will be refunded after deduction of reasonable costs already incurred.
7. How to Cancel
If you wish to cancel a contract, please notify HomeTech Wales as soon as possible.
You may do this by telephone, email or in writing. For your convenience, HomeTech Wales also provides HT005A – Cancellation Request Form, which may be completed and submitted if you wish to exercise your cancellation rights. Use of this form is optional and is provided to make the cancellation process easier.
Please include, where available:
- Your name.
- Property address.
- Quotation or invoice reference.
- A brief statement confirming that you wish to cancel.
